We at SOFTICO S.R.L. (hereinafter referred to as “SOFTICO”, “Company”, “we”, “us”, “our”) respect your privacy. This Privacy Policy (hereinafter referred to as the “Policy”) explains the privacy practices for the SOFTICO website –http://www.softico.tech/ (hereinafter referred to as the “website”, “site”), describes the rights and options available to you in relation to your personal information, and also regulates legal relations in the field of personal data protection between you and SOFTICO.
SOFTICO is committed to protecting privacy and creates measures to protect the personal data of SOFTICO Clients (hereinafter referred to as “Clients”, “Users”, “you”) and to minimize the collection of such data. We will not use your personal information for any purposes not provided for in this Policy, the SOFTICO Cookie Policy without prior notice to you and your consent. The Company collects and processes the personal data of Users only in the ways described in this Policy, taking into account the Company’s obligations under the law.
By visiting, accessing or using the SOFTICO website, you acknowledge that you agree to this Policy and accept Terms of Use, posted on the website, so please read them carefully. By providing SOFTICO with your personal data, you consent to the collection, storage, use, processing and disclosure of your personal data in accordance with this Policy.
If you are not an interested party, a SOFTICO Client, but use the Company’s website, the provisions of this Policy also apply to you. This Policy should be read together with our Cookie Policy, which contains additional information about the Company’s use of cookies on the website.
1. The following terms are used in this Policy:
1.1 personal data – any information relating to an individual who is identified or can be identified using that data. This includes information that you provide to us, information that is collected about you automatically, and information that we receive from public sources, registers, etc.;
1.2 processing is any operation or set of operations which is performed on personal data or on sets of personal data, whether or not by automated means, such as collection, recording, organisation, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, compilation or combination, restriction, erasure or destruction;
1.3 the controller is the person who determines the purposes and methods of collecting and/or processing information/personal data. 1.5 GDPR – General Data Protection Regulation, the rules of which govern the processing of personal data.
2. Personal data that SOFTICO collects and processes
We may collect personal information about you in the course of our business, including when you use our website, when you contact us or request information from us, or when you use our services, when you purchase or subscribe to our products or services, or as a result of your relationship with one or more of our employees.
To achieve the purposes specified in this Policy, we may collect and process personal data provided by you. Such data may include identifiers such as:
– your full name;
– the country you are in;
– telephone number;
– email address and/or postal address;
– position and place of work;
– financial/payment information;
– information required to carry out relevant procedures, such as KYC and AML (including information on the source of funds), as well as within the framework of other necessary procedures;
– information obtained during communication with customer support;
– any data that you provide to us to provide you with services.
The above list of information is not exhaustive, but merely reflects the diverse nature of personal data that is processed within the framework of the Company’s activities.
We also process information that SOFTICO collects automatically. when you use the Company’s services. Such information speeds up the resolution of User support issues, improves the performance of the site and the Company’s interaction with the Client.
The following types of information are collected automatically, in particular:
– information about your device and your use/browsing of the website (e.g. device identifier, device type category and model, operating system and its versions, unique device identifiers, web browsing information, location data, IP address from which the Company’s website is accessed, etc.);
– information about the type and version of the browser you are using;
– public data imported by the Client into SOFTICO;
– information from cookie files;
– other non-personalized traffic data.
SOFTICO may also collect personal data about Clients from third parties, for example, when providing services, the Company may use software and other means, tools of third parties (independent service providers), which also collect your personal data. In such cases, the Company takes reasonable measures to ensure that they are informed of the relevant privacy laws. The procedure for collecting, processing, storing and using personal data is determined by the Privacy Policy of the relevant service provider.
3. Legal grounds and purpose of processing personal data of Users
1. The processing of personal data is necessary for the performance of the Agreement with the Client or for taking action at the Client’s request – GDPR, Article 6(1)(b).
2. The processing of the Client’s personal data is necessary for compliance with a legal obligation, due to a significant public interest based on EU or EU Member State law – GDPR, Article 6(1)(c).
3 The processing of the Client’s personal data is necessary to protect the legitimate interests of both SOFTICO and the Users – GDPR, Article 6(1)(f). In particular, to ensure the security of the SOFTICO system for the purpose of monitoring performance, errors and eliminating deficiencies, as well as to improve the functioning and usability of SOFTICO services.
4. Processing of personal data with the consent of the Client – GDPR, Article 6(1)(a). SOFTICO requests the consent of Users to process personal data for the provision of promotions, placement of cookies and similar technologies, for marketing purposes, etc.
SOFTICO collects your personal data, among other things, for the purpose of:
- confirm your identity;
- support the Client and provide our services;
- improvements and increase in the number of services available to the Client;
- improving the SOFTICO website, developing and providing additional features/tools;
- fulfilling a request made by you on the website or in another way; ensure compliance with our agreements with you;
- performing actions for which we have received the Client’s consent to process personal data;
- investigation or resolution of disputes, consideration of requests and complaints from Clients, and for communication;
- compliance with legal and regulatory requirements, compliance with the Policy, a court order, other judicial proceedings or the requirements of an authorized body;
- to promote security, prevent and detect fraud, prevent abuse of the Company’s services, prevent or stop activity that we may consider illegal;
- protect the rights, property, or safety of us or third parties, including our other customers and users of the Site;
- use in other cases required or permitted by law.
4. Age restrictions. Personal data of children
The Company does not permit individuals under the age of 18 to use SOFTICO services. The Company does not knowingly request, collect or process personal data from individuals under the age of 18.
If you are under 18 years of age, please do not provide any personal information to SOFTICO. If it is determined that the person who provided personal information is under 18 years of age, SOFTICO will take the necessary steps to delete that person’s information as soon as possible.

5. Transfer and disclosure of personal data of Users
SOFTICO does not sell your personal data or transfer it to third parties, except in cases listed in this Policy. Your personal data may be subject to disclosure only in cases specified by applicable law, in particular the GDPR, as well as this Policy.
In exceptional cases, when required by the rules and policies of third-party financial institutions for the purpose of identifying the Client and ensuring the provision of our services to him, certain personal data of the Client (e.g. contact and/or identification data) may be transferred to such financial institutions.
Personal data may also be transferred to third parties – service providers. SOFTICO may disclose some personal data to service providers that provide us with services such as cloud services/servers, insurance, analytics, research, and other services or that cooperate with us directly to provide our services to Clients. In this case, SOFTICO provides service providers with the minimum amount of personal data necessary only to provide a specific service. Such information will not be provided to third parties for their marketing purposes.
SOFTICO may disclose Users’ personal data to government agencies or governmental organizations in accordance with the provisions of law, court orders, legal proceedings and/or based on public inquiries or requests from government agencies within or outside your country of residence.
The Company may also disclose your personal data if it believes that such disclosure is necessary or appropriate for national security, compliance with laws, enforcement of the SOFTICO User Agreement, or for the purposes of protecting the operations of SOFTICO and our Users, as well as in accordance with other socially important reasons.
In addition, if the ownership of SOFTICO changes as a result of a merger, acquisition, transfer, sale of assets, reorganization or bankruptcy, your personal data may be transferred to the legal successor. The legal basis will be GDPR, Article 6(1)(f) (legitimate interest).
6. Storage and deletion of personal data of Users
SOFTICO retains your personal data for the period necessary to achieve the purposes set out in this Policy, as well as for as long as it is in our legitimate interests or is necessary to comply with our legal obligations. We will review your personal data every year to determine whether we have the right to process it. If we find that we do not have such a right, we will stop processing your personal data.
In this case, in cases and within the timeframes provided by law, we reserve the right to store/process personal data in accordance with the specific purposes of their storage and processing. For example, your personal data may be stored if this is necessary to fulfill our legal obligation, GDPR, Article 6(1)(c).
After the data retention period has expired, SOFTICO applies procedures to destroy, delete, erase or convert the data into an encrypted format.
You may delete your personal data at your discretion. You may revoke consent and/or request deletion of your personal data at any time by contacting us at:info@softico.tech.
Withdrawal of consent and/or deletion of your personal data will prevent you from using certain SOFTICO services.
7. Security of personal data
For SOFTICO, the security of your personal data is a top priority. The Company has implemented appropriate organizational procedures, as well as relevant policies, rules and technical information security measures to protect the personal information under our control from unauthorized access, improper use or disclosure, unauthorized modification and unlawful destruction or accidental loss.
8. International transfer of personal data
SOFTICO may transfer your personal data to countries other than your country of residence (including countries outside the European Economic Area). International transfers occur when providing services or because our partners or service providers operate in other countries around the world.
The European Commission has determined that certain countries outside the European Union offer an adequate level of data protection (GDPR, Article 45).
The company ensures that appropriate security measures are in place to ensure compliance with the requirements of international transfers of personal data in accordance with applicable privacy laws. For transfers of personal data outside the European Economic Area, SOFTICO uses standard contractual clauses approved by the European Commission as guarantees (GDPR, Article 46).
9. Rights of the personal data subject
You have the following rights in relation to your personal data:
– the right of access – the right to obtain from SOFTICO confirmation of whether your personal data is being processed, the purpose of this processing, the categories of data collected, the recipients to whom this personal data has been/will be disclosed, etc.;
– the right to receive information – the right to receive information from SOFTICO about the collection and processing of your personal data (e.g. who collected and processed the personal data; the purpose of processing your personal data; the storage period of personal data; to whom your personal data will be transferred, etc.);
– the right to rectify data – the right to request that SOFTICO correct your inaccurate personal data, as well as the right to make additions to the data;
– the right to erasure/“right to be forgotten” – the right to request that SOFTICO erase your personal data if the personal data is no longer necessary in view of the purposes for which it was collected or processed, or if there is no longer any legal basis for its processing;
– the right to limit data processing – the right to ask SOFTICO, in certain cases, to temporarily limit the processing of your personal data if there are compelling reasons for doing so. The company may continue to process your personal data if this is necessary to defend legal claims or in any other cases permitted by applicable law;
– the right to object – the right to object to the processing of your personal data at any time;
– the right to data portability/portability – in some cases, you may request to receive your personal data provided to SOFTICO in a structured, commonly used and machine-readable format or, where possible, for us to transmit your personal data on your behalf directly to another data controller;
– the right to withdraw consent – the right to withdraw your consent to the processing of your personal data at any time. The exercise of this right does not affect the lawfulness of processing based on consent given before its withdrawal.

10. Changes to the Privacy Policy
We reserve the right to change this Policy at our discretion and at any time. Any changes to this SOFTICO Policy will be effective upon publication on the website. Your continued use of our website after changes have been published constitutes your acceptance of the amended Policy. We will always indicate the date of publication of the most recent changes.
